x 0   x 0  Alert Admin	手 机 新 浪 网 网 站 导 航 财 经 财 经 要 闻 历 年 马 来 西 亚 航 空 界 空 难 盘 点 新 环 保 法 实 施 :罚 款 没 有 上 限 2015-01-01 05:19 中 国 青 年 报 4 　 　 违 法 排 污 的 行 为 要 按 日 计 罚 ， 并 且 没 有 上 限 ； 通 过 暗 管 排 污 、 或 者 篡 改 监 测 数 据 的 责 任 主 体 ， 有 可 能 被 公 安 部 门 拘 留 ， 构 成 犯 罪 的 要 被 追 究 刑 事 责 任 ??由 于 ?罚 款 没 有 上 限 ， 违 法 排 污 者 有 可 能 面 临 失 去 人 身 自 由 的 惩 处 ?等 条 款 的 写 入 ， 2015年 1月 1日 起 开 始 实 施 的 新 环 保 法 ， 被 学 界 认 为 是 史 上 最 严 的 环 保 法 。 　 　 在 环 保 部 副 部 长 潘 岳 看 来 ， 这 部 被 形 容 为 ?长 了 牙 齿 ?的 环 保 法 ， 既 彰 显 了 中 央 政 府 向 污 染 宣 战 的 决 心 ， 也 回 应 了 民 众 对 APEC蓝 等 好 环 境 的 期 待 ， 而 当 下 最 重 要 的 则 是 ， 执 法 者 如 何 铁 腕 执 法 ， 确 保 最 严 格 的 法 律 不 成 为 一 纸 空 文 。 　 　 法 律 的 威 慑 力 大 大 增 强 　 　 此 次 环 保 法 大 修 距 离 上 次 修 订 已 经 25年 ， 修 改 的 过 程 也 颇 为 曲 折 ， 历 经 两 届 人 大 ， 两 次 向 社 会 征 求 意 见 。 湖 北 经 济 学 院 院 长 吕 忠 梅 记 得 ， 此 次 修 法 一 开 始 还 只 是 修 订 ， 随 着 民 众 关 注 度 越 来 越 高 ， 最 后 改 为 了 修 改 。 从 修 订 到 修 改 ， 虽 然 只 有 一 字 之 差 ， 但 却 是 伤 筋 动 骨 的 变 化 ， 尤 其 是 改 变 了 环 保 法 长 期 以 来 是 部 ?软 法 ?的 局 面 。 　 　 修 改 前 的 环 保 法 ， 环 保 部 门 对 违 法 排 污 企 业 的 罚 款 上 限 是 100万 元 ， 且 对 一 个 污 染 行 为 只 能 处 罚 一 次 ， 几 十 年 间 ， 被 环 保 部 门 罚 过 100万 元 的 企 业 屈 指 可 数 。 不 少 地 方 甚 至 出 现 过 下 面 的 情 景 ： 年 初 ， 污 染 企 业 拿 着 钱 去 环 保 部 门 ， 表 示 这 是 一 年 的 罚 款 ， 一 次 交 够 了 ， 环 保 部 门 全 年 都 不 用 来 执 法 了 。 　 　 修 改 后 的 环 保 法 最 大 的 亮 点 是 ， 对 拒 不 改 正 违 法 排 污 行 为 的 企 业 ， 环 保 部 门 可 以 按 日 计 罚 ， 而 且 上 不 封 顶 。 也 就 是 说 ， 对 企 业 的 违 法 行 为 ， 环 保 部 门 可 以 按 日 连 续 累 计 处 罚 ， 直 至 企 业 改 正 。 　 　 中 国 政 法 大 学 教 授 王 灿 发 多 年 来 一 直 呼 吁 提 高 对 环 境 违 法 行 为 的 惩 处 力 度 ， 他 也 是 按 日 计 罚 的 积 极 推 动 者 。 据 王 灿 发 介 绍 ， 按 日 计 罚 是 发 达 国 家 比 较 成 熟 的 处 罚 制 度 ， 我 国 的 重 庆 市 几 年 前 通 过 地 方 立 法 引 入 按 日 计 罚 这 一 制 度 后 ， 对 企 业 的 违 法 排 污 行 为 起 到 了 震 慑 作 用 。 重 庆 引 入 按 日 计 罚 之 前 ， 企 业 被 环 保 部 门 发 现 违 法 排 污 后 ， 改 正 率 只 有 4.8%， 但 按 日 计 罚 写 入 地 方 法 规 后 ， 这 一 数 字 提 高 至 84%。 随 着 环 保 部 门 的 严 格 执 法 ， 目 前 企 业 对 违 法 行 为 的 改 正 率 已 经 在 90%以 上 。 　 　 在 王 灿 发 看 来 ， 连 续 的 、 不 设 限 的 罚 款 只 是 新 环 保 法 震 慑 违 法 企 业 的 第 一 步 ， 司 法 、 刑 法 的 惩 处 将 使 得 违 法 排 污 者 面 临 人 身 自 由 的 限 制 。 　 　 事 实 上 ， 在 新 环 保 法 正 式 出 台 之 前 ， 最 高 人 民 法 院 和 最 高 人 民 检 察 院 已 就 惩 治 环 境 污 染 犯 罪 作 出 司 法 解 释 ， 加 大 了 对 环 境 违 法 行 为 的 处 罚

Well what we are witnessing might be BB left pocket sell to right pocket....  On one hand they are really selling their shares,    other hand buying even more shares than they sell (at much lower price) End of the day.. they will get more shares than what they have sold....without spending additional $$ They are able to buy back more shares than what they have sold because lots of panic investors are throwing as well.   So, They keep repeating this cycle... and over a period, they will accumulate alot more shares than they orignally have at a much much lower price.  Until one day, they realised no more retailer are selling... then is time to fry up the stock... You will not be able to see this because it will be done very skillfully, But but... no matter what they do is not important... Price falling with high volume is a fact. If u short sgx and never cover within the day... u will be heavily penalised.
