Now that Linc Energy is liquidated/bankrupted, I guess there is no more incentive to continue running that contamination story anymore, since there is nobody left to chop carrot head off of? In fact, if true, they have to reverse the story asap if the owners want to retain/regain the value of their existing land parcels. Contaminated land, officially/nationally declared esp, isn' t worth much?

So he is alleging that, while some are geniuinely afraid, other land owners might have latched onto the contamination claims on the hope they could land a " financial windfall" from either the govt or linc energy?

I got this article from forumers in Australia..... ' Never any contamination from Linc Energy' says Chinchilla grazierMark  Phelps@MarkQCL24  Jul 2019, 12:06 p.m.News RELIEF: Chinchilla grazier Toby Trebilco says the truth is out.AaCHINCHILLA grazier Toby Trebilco is adamant. The truth is out.He says despite years of intensive testing no contamination has ever been detected in the water, soil, crops or livestock as a result of alleged contamination caused by the Linc Energy underground coal gasification facility at Chinchilla." There' s nothing, not a thing, and never has been because there never has been any contamination," Mr Trebilco said, who owns and lives on the adjoining property Ewerleigh. There' s nothing, not a thing, and never has been because there never has been any contamination.- Toby Trebilco, Ewerleigh, Chinchilla" If there ever was any contamination we would have been out of business long ago. " Contamination would have shown up in everything we do here." The alleged contamination caused by Linc saw the Queensland Government declare 32,000 hectares of Queensland' s top agricultural land as a ' no excavation zone' , affecting 130 landholders centred on the highly productive Hopeland farming district. That zoning was lifted in early 2018. However, the Queensland Government more recently placed a ban on coal seam gas drilling in a 10km radius zone around the former Linc site. The now liquidated Linc Energy was fined $4.5 million after its was charged with five counts of wilfully and unlawfully causing environmental harm between 2007 and 2013. The Queensland Government recently gifted Toby Trebilco a 140m deep test bore used to monitor Linc Energy.Partly why Mr Trebilco is so sure of his ground is that the Queensland Government recently gifted him a 140m deep test bore. That bore sits about 1km from Linc' s now mothballed facility. That bore has been constantly monitored and tested since it was sunk in 2001. " If there was any risk of contamination they would never have given me the bore," Mr Trebilco said. " The only thing the past 18 years has shown is there has never been a change in the quality of the water. " Every time the result has been the same. There is absolutely no contamination." Mr Trebilco said he was particularly horrified on May 16, 2015 when he watched ABC TV news reports falsely reporting the underground water table was contaminated and thousands of tonnes of soil would have to be shifted." I thought it was all over then, even though our family had been here since selection in the early 1900s and have other landholdings in the Hopeland district," Mr Trebilco said. " I immediately rang our meatworks because we were having cattle killed the next day. " Fortunately our water tests showed there was never a problem and the cattle were processed without any issue." Mr Trebilco said while he understood some landholders held genuine fears, others were driven by greed, hoping to secure a financial windfall. " The truth will always comes out clean and you don' t have to do anything else," Mr Trebilco said." This is the most wicked business I have ever been through in my life." Hope the Queensland Government give us back our investment !!!!!   |

Hi Pal out there, please help this forumer in www.hotcopper.com.au to find out the question he addressed... Seems that any hope of a CA is now looking more than likely... Green Hornet 07/06/19 17:47 Post #: 38966294 Seems that any hope of a CA is now looking more than likely being a non event-maybe Problem is that we are running out of time and the other spanner in the works is the move to the SGX. Not sure about the laws against companies in Singapore so if anyone out there is familiar with the laws against a company their would be much appreciated. Any info would be welcome and could be sent to me at [email protected] Thanks... |

1.1 HIGH COURT RULES AGAINST QUEENSLAND STATE GOVERNMENT ON ENVIRONMENTAL PROTECTION ORDER In March 2018, the Queensland Court of Appeal delivered a judgment in favour of the liquidators of Linc Energy Limited (in Liquidation) (Linc Energy), to the effect that the liquidators were justified in not causing Linc Energy to comply with an Environmental Protection Order (EPO) issued against the Company by the Queensland Department of Environment and Science (DES) (formerly the Department of Environment and Heritage Protection) in May 2016. This judgment overturned an earlier decision of the Supreme Court of Queensland. The Queensland State Government, through the DES and the State Attorney-General, filed applications for special leave to appeal to the High Court of Australia in April 2018. Following a hearing on 14 September 2018, the High Court refused to grant special leave to the State and awarded the liquidators their costs of the special leave applications. The High Court&rsquo s refusal to grant special leave to the Queensland State Government marks the end to over two years of legal dispute regarding the obligations of both Linc Energy and the liquidators with respect to the EPO. With the issue now resolved, the liquidators intend to proceed with completing the orderly winding up of Linc Energy.  | ||||

By the way have also been in talks with a legal team in relation to a possible class action against the board and management of the company for not keeping shareholders in the loop if knowing that a problem with the site. Apparently Directors and Management have Insurance coverage for actions against them so will see how the talks go and keep all that may be interested updated on any possibility. They also advised me to run is past PPB as well as they MAY be thinking of something similar, have done as well and awaiting a reply The above article was by Investor " Green Hornet" |

10 May 2018 (1) UPDATES PURSUANT TO RULE 704(23) OF THE LISTING MANUAL 1. UPDATES PURSUANT TO RULE 704(23) OF THE LISTING MANUAL Pursuant to Rule 704(23) of the Listing Manual (" Listing Manual" ) of the Singapore Exchange Securities Trading Limited (" SGX-ST" ), the Liquidators announce updates relating to Linc Energy Limited (In Liquidation) (the Company) as follows: 1.1 CRIMINAL PROCEEDINGS AGAINST THE COMPANY On 9 April 2018, the Brisbane District Court found that the Company was guilty in respect of five charges of wilfully and unlawfully causing serious environmental harm, in contravention of subsection 437(1) of the Environmental Protection Act 1994 (Qld). The conviction follows a lengthy trial that commenced against the Company on 29 January 2018, relating to the operations of the Company&rsquo s underground coal gasification facility at Chinchilla, Queensland, over the period 2007 to 2013. The Liquidators had previously obtained directions from the Supreme Court of Queensland in October 2016 to the effect that they were justified in not causing the Company to defend the five charges. These directions were obtained on the basis that any penalty awarded against the Company as a result of a conviction would not be provable as a debt in the liquidation of the Company. It was therefore not in the interests of the creditors of the company for the Liquidators to incur the significant legal costs that would have been associated with defending the charges. The sentencing hearing for the Company has been listed for 11 May 2018 in the Brisbane District Court. Further announcements will be made by the Company to keep its shareholders updated on any material developments as and when appropriate. Any enquiries should be directed to: PPB Advisory Phone: +61 7 3222 6800 [email protected] | ||||
